Terms of use.

The contract between you and Swifli. Written to be readable, not to hide. If a section is unclear, email legal@swifli.co and we'll explain.

1. Who's agreeing

These terms ("Terms") are a contract between you and Swifli Technologies Inc., the company that operates Swifli ("Swifli", "we", "us"). They apply whether you're a resident booking services, a provider listing services, or a property manager referring residents.

By creating an account or using the Swifli platform, you agree to these Terms. If you don't, don't use the platform.

2. Swifli is a marketplace

Swifli is not the service provider. Service providers on Swifli are independent contractors. They set their own rates within published category floors, accept and decline their own jobs, and perform the work themselves.

Swifli's role is to: verify providers, match supply with demand, hold and release payment through escrow, facilitate communications, and adjudicate disputes through our published trust and safety processes.

3. Account, eligibility, and conduct

You must be 18 or older to create a Swifli account. You agree to provide accurate information at signup and keep it current. You're responsible for activity that happens under your account.

You agree not to: use Swifli for anything illegal, harass or abuse other users, attempt to evade safety mechanisms (including masked phone numbers and in-app messaging), submit fraudulent bookings, or use Swifli's data outside the platform for any purpose.

4. Bookings, payment, and escrow

When you book a service, the booking amount is charged to your payment method and held in Swifli-controlled escrow. Funds remain in escrow until: (a) you confirm the work is complete (release), (b) the auto-release window passes without your action (release), or (c) you raise a dispute (held pending resolution).

Swifli's platform fee is 15% of the booking amount, deducted from the provider's payout. Other fees, if any, are disclosed at booking. What you see at booking is what you pay.

5. Disputes

Disputes are handled through the four-stage process described on our Trust & Safety page. Both parties agree to engage in good faith with the published process before any legal action.

6. Cancellation

Residents may cancel free of charge until the cancellation window for the category (typically 4–24 hours before scheduled start time). Cancellations inside the window may incur a partial fee paid to the provider for held time. Cancellation rules are shown at booking.

7. Provider obligations

By listing as a provider, you represent that you have the right to perform the services you're offering, hold any required licenses or credentials, carry the insurance required by Swifli's Trust & Safety policy, and will report income earned through Swifli as required by tax law.

You acknowledge that you are an independent contractor, not an employee of Swifli or Swifli Technologies Inc.

8. Property manager partnerships

Property manager partnerships are governed by a separate signed partnership agreement that incorporates these Terms by reference. Commission structures, payment schedules, and term lengths are specified in the partnership agreement.

9. Content and intellectual property

You retain ownership of content you upload to Swifli (photos, messages, profile details), but grant Swifli a license to use it for operating, improving, and marketing the platform, with attribution where reasonable. Swifli's trademarks, design, and platform code are owned by Swifli Technologies Inc.

10. Liability

Swifli operates the platform "as is" and makes no warranty about the outcome of any specific booking. Disputes between residents and providers are resolved through our process; Swifli's financial liability is capped at the value of the disputed booking.

This section is constrained by Ontario consumer protection law; nothing in it limits rights you have under law that cannot be contracted away.

11. Suspension and termination

Swifli may suspend or terminate an account that violates these Terms, fails verification, accrues repeated dispute losses, or otherwise harms the integrity of the marketplace. You may close your account at any time; the closure becomes effective when any open bookings or escrow funds are resolved.

12. Changes to terms

We may update these Terms when our practices change materially. We notify users in-app and by email, with at least 14 days' notice before material changes take effect. Continued use of Swifli after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Disputes that cannot be resolved through our internal process are subject to the exclusive jurisdiction of the courts of Ontario.
